LC30 : driving after making a false declaration about fitness when applying for a licence

What it means

LC30 reaches back to the desk: the declaration about fitness was made when the licence was applied for, and the offence is the driving that follows it. The courtroom half is often the smaller half, because the same false answer surfaces twice more: the DVLA revisits the licence, and an insurer who relied on the declaration can treat a deliberate misrepresentation as voiding the cover under CIDRA 2012. Of the medical trio this is the deliberate one; LC40 is its careless sibling.

Points and how long it stays

3 to 6 points.

On the licence for 4 years from the date of the offence.

The LC codes are the licence's own offences, 3 to 6 points each on the 4-year offence clock, one everyday code and a medical trio. LC20 is the everyday one, driving otherwise than in accordance with a licence, s. 87 RTA 1988: the learner outside the conditions, the category that was never held. LC30, LC40 and LC50 share a spine that runs through the DVLA's medical file, the false fitness declaration, the condition never notified under s. 94, the driving after a medical refusal or revocation under s. 94A. Two shadows fall across the whole family: insurance, because cover generally stands on entitlement and IN10 often arrives on the same facts, and the DVLA itself, which usually moves against the licence before the courtroom moves at all. The usual route

There is no roadside route: the case arrives as a court charge, usually after the DVLA's medical file has reopened.
