Zustellung, the formal delivery that starts clocks and binds courts, §§ 166 ff. ZPO. Service in this sense has nothing to do with Dienstleistungen, and the process agent the English clause appoints is in German a Zustellungsbevollmächtigter.

Which translation, when

Zustellungthe formal act, §§ 166 ff. ZPO, documents delivered in statutory form, with proof, because deadlines and default judgments hang on the date. The only correct rendering for service of proceedings.

Why

Service of process is the formal delivery of proceedings, and German procedure treats it with ceremony, the Zustellung of §§ 166 ff. ZPO, performed in statutory ways, documented, dated, because limitation stops, deadlines start and default judgments stand or fall on it. The everyday senses of service, the Dienstleistung of a services agreement, the Kundendienst of a warranty card, live in a different world, and the machine does not always notice which world the sentence is in. Cross-border drafting leans on the term twice, English contracts with German parties appoint a process agent, in German a Zustellungsbevollmächtigter, § 171 ZPO for the appointed recipient, § 184 ZPO for the court-ordered version when a party sits abroad, and a clause translated with Dienstleistungen in it has turned the machinery of jurisdiction into customer support.

Typical mistakes

  • Dienstleistung anywhere near proceedings is the tell, service of the claim is die Zustellung der Klage, and the reader who meets Dienstleistung in that sentence knows no lawyer touched the text.
  • Bedienung and Kundendienst are the other everyday senses, harmless in a manual, absurd in a jurisdiction clause, the procedural word is Zustellung and only Zustellung.
  • The process agent clause has a German name and a German norm, Zustellungsbevollmächtigter, § 171 ZPO, and flattening it to a generic Vertreter loses the one thing the clause exists for, that service on this person counts.

What matters

Cross-border jurisdiction boilerplate is where the clause lives: each party appoints X as its agent for service of process reads jede Partei benennt X als Zustellungsbevollmächtigten, § 171 ZPO. Rendered with Dienstleistungen the clause reads like an outsourcing arrangement, and the one procedural safeguard the parties negotiated, a safe address for the Zustellung, is no longer stated in the words German procedure recognises.

What the machine misses

Service of process wrong-foots the engines through its first word, service pulls the output towards Dienstleistung, and proceedings arrive wrapped in customer-service vocabulary. The formal act German procedure builds deadlines on, the Zustellung, is a different register entirely, and a jurisdiction clause that promises Dienstleistungen instead has translated the noun and lost the institution.
