BA40 : causing death by driving while disqualified

What it means
BA40 exists because Parliament decided in 2015 that the disqualification itself aggravates the death: causing death by driving while disqualified, s. 3ZC RTA 1988. On the record the endorsement is the footnote, 3 to 11 points on a 4-year clock that runs from conviction rather than the offence, one of only two BA codes that start at the courtroom door. Everything that matters here is sentence, not points.

BA is the smallest family with the widest spread. BA10 and BA30, driving or attempting to drive while disqualified, s. 103 RTA 1988, carry a flat 6 on the 4-year offence clock and are summary matters with custody available. BA40 and BA60, causing death or serious injury by driving while disqualified, s. 3ZC and s. 3ZD RTA 1988, came in 2015, carry 3 to 11 points, and their 4-year clock runs from conviction instead. No code here has a fixed penalty route: a disqualified driver at the wheel is charged, not ticketed. If it goes to court
The offence was created by the Criminal Justice and Courts Act 2015 to put substantial custody behind the disqualification order, s. 3ZC RTA 1988; sentence is measured against custody, far above the fine band world.
