NE96 : disqualification imposed under the child support, pensions & social security act 2000

What it means
NE96 is the code for losing a licence over unpaid child maintenance. The power sits in ss. 39A and 40B of the Child Support Act 1991, inserted by the 2000 Act the list names: up to two years, only on a finding of wilful refusal or culpable neglect, with the court obliged to ask whether the licence earns the person's living. On application, the court can shorten or lift the order as the arrears are paid down, s. 40B(5). No points attach, and the public list gives no retention period for NE codes.
Points and how long it stays
The NE codes are the register's other tier: no penalty points, because the entry is not an endorsement at all but the record of a disqualification. The current gov.uk list carries four. NE96 is child maintenance enforcement, ss. 39A and 40B Child Support Act 1991; NE97 records interim-disqualification states, the s. 26 RTOA 1988 procedure; NE98 is the court's general power to disqualify for a non-endorsable offence, the anti-social behaviour route; NE99 gives effect in Great Britain to bans from Northern Ireland or the Isle of Man, while bans from the Republic of Ireland run under the MR codes at /fines/codes. DVLA shows the entries to the driver and to third parties such as insurers and the police. The list names no retention period for NE codes, and any disqualification of 56 days or more means renewing the licence, for a fee, once the ban ends.
The usual route
No ticket and no motoring offence: the ban is a child maintenance enforcement measure.
If it goes to court
A magistrates' court (in Scotland the sheriff) imposes it on a child maintenance application where it finds wilful refusal or culpable neglect to pay, s. 39A Child Support Act 1991; the alternative on the same application is committal to prison.
